There are levels of risk associated with all food handling and food registration.
High risk foods
If you are selling food that is high risk such as requiring refrigeration or have any level of handling.
There are various types of food operations:
- Fixed food business which includes operations such as restaurant café aged care facility food factory home business.
- Temporary/portable food operation – such as operating out of a marquee or setting up at an event or in a hall
- Mobile food business – such as a cart vehicle or trailer
- Water carter
- Food vending machine
- this list is not exhaustive and if you are not sure what level of risk your food would be please contact us and we will assist.
The way the food is prepared and the scale of production will determine the class of food registration. Some of these classifications are predetermined but our EHOs will assist businesses to finalise the registration.
Low risk foods
If you are selling low risk foods such as packaged goods you will simply have to notify us as registration is no long required for Class 4 foods.
This can be done for:

We always aim to educate and help businesses comply with the Food Act 1984 or the Food Standards Code. However where this hasn’t worked to address a problem or there’s a risk to public health enforcement action can be taken by Council. Enforcement action can range from warnings and Food Act Orders up to fines and even prosecution. Some of the common non compliant issues we see are not having adequate hand washing facilities having uncovered foods on display staff members not handling foods safely staff coming to work with gastro symptoms/food poisoning or not paying a Food Act renewal on time.
-
When you lodge a new Food or Public Health and Wellbeing Act application we will be in contact with you by email or phone within 10 working days of receiving your application. An application for a food or health registration can take between 4 and 6 weeks before approval to trade is given. This does not include any building or planning permit requirements which is a separate application process with the relevant departments. Missing or incorrect information and not being able to contact the applicant are common problems the assessing officer may have and this delays the approval of your business.

The Food and Health renewals are sent by email. The renewal notice and certificate are attached to the email as a PDF document. If you have not received your renewal and certificate by the end of December you should check: your spam or junk folder – some public email accounts like hotmail yahoo and gmail treat all PDF as spam all the email accounts you may have told Council about. We have sent the email to the registered proprietor’s email address that was given at time of registration or when you have updated this with us. If you still believe you have not received it then contact us.  Â
